How To Respond If You Have A BIR Audit?

If you are a taxpayer in the Philippines and are subject to a tax audit, this article will give you the basic information and procedures in responding to the audit.

The first step in the audit process is the issuance of the Letter of Authority or LOA by the Bureau of Internal Revenue or BIR. The LOA is an official document that would allow the BIR officers to furnish a copy of the taxpayer’s accounting records and books of accounts for further examination, scrutiny, and evaluation to determine if tax liabilities were paid correctly. The Letter of Authority is issued by the BIR Commissioner for taxpayers under the jurisdiction of the National Office. For taxpayers under the Regional Offices, LOA will be issued by the Regional Director.

The Letter of Authority is documentation that recognizes the taxpayer’s rights to due process, therefore, any BIR officials conducting an audit without prior issuance of the LOA is a violation of the taxpayer’s rights.

Take note that the LOA is served in person and not via postal mail or courier by an authorized BIR employee or official. The bearer’s name is stated in the LOA document so, the taxpayer accepting the Letter of Authority should verify if the bearer’s name in the LOA matches the bearer’s ID. If the Identification Card doesn’t match the LOA, the taxpayer has the right to refuse the Letter of Authority. Verify with the BIR office of such issuance.

Another important note to take into account is the manner of serving the LOA to the intended taxpayer. The name of the taxpayer is stated in the Letter of Authority and therefore must be served to the addressee alone. If the LOA was received by a person other than the name addressed in the letter, the LOA is considered Null and Void.

The LOA must be served within 30 days from the issuance date reflected in the letter. Serving outside the timeframe nullifies the validity. The taxpayer has the right to refuse receipt if served after 30 days from the date of the letter. LOA must be revalidated first and reissued. Revalidation is allowed twice for the National Office and once for Regional Offices. The voided LOA must be attached to the new LOA when served.

In the event that the taxpayer refuses to accept the Letter of Authority for the reasons stated above, a letter of protest must be submitted to the BIR office.

The Letter of Authority includes a list of documents that are required by the BIR. If there are documents in the checklist that are not applicable to you, these items must be indicated on your submission transmittal page as N/A or Not Applicable, meaning, when you submit the documents, you will also need to provide a cover page that lists down all the documents that are included in your submission packet.

Compliance with the LOA is within 10 days from the issuance date. Failure to comply within 10 days will trigger the first notice. This notice will give the taxpayer another 10 days. If still, the 10 days extension is not enough to gather your documents, and you will again fail to comply then a second and final notice will be served. If you again fail to comply with the second and final notice, this time, a subpoena will be served.

The revenue officer conducting the audit is given 120 days to complete the audit process. If it goes beyond the allocated number of days, a Progress Report must be submitted by the officer to the Head Office, and surrender the Letter of Authority for revalidation.

Benigno Aquino III, full name Benigno Simeon Cojuangco Aquino III, (nicknames: Pnoy, Noynoy) was the 15th president of the Philippines from 2010 to 2016. He was the son of the 11th president of the Philippines Corazon Cojuangco Aquino.

Pnoy was born on February 8, 1960, at Far Eastern University Hospital in Sampaloc, Manila. He is the third of the five children of Benigno Aquino Jr., and former president Corazon C. Aquino. Benigno Aquino Jr., with nickname Ninoy, was the former vice governor of Tarlac, and later became a Senator, was assassinated on Sunday, August 21, 1983, at the tarmac of the Manila International Airport, now called Ninoy Aquino International Airport after Cory Aquino, his wife changed the airport’s name from MIA to NAIA when she became the president of the Philippines after the People Power Revolution in 1986 that ousted former President Ferdinand Marcos. His mother, the late Corazon C. Aquino, was the 11th president of the Philippines. Corazon Cojuangco is the daughter of a prominent Tarlac businessman.

TAAL VOLCANO BULLETIN 29 March 2021 08:00 A.M.

In the past 24-hour period, the Taal Volcano Network recorded nineteen (19) volcanic earthquakes, including twelve (12) episodes of volcanic tremor having durations of one (1) to eleven (11) minutes, and seven (7) low-frequency volcanic earthquakes. Activity at the Main Crater consisted of weak emission of steam-laden plumes from fumarolic vents that rose forty (40) meters. Sulfur dioxide (SO2) emission averaged 837 tonnes/day yesterday, 28 March 2021.

Temperature highs of 71.8°C and pH of 1.59 were last measured from the Main Crater Lake respectively on 04 March and 12 February 2021. Ground deformation parameters from electronic tilt, continuous GPS, and InSAR data analysis indicated very slow and steady inflation and expansion of the Taal region since after the January 2020 eruption.

These parameters may indicate increased magmatic activity at shallow depths beneath the edifice. Alert Level 2 (Increased Unrest) is currently maintained over Taal Volcano but that unrest has been elevating and is under constant evaluation. DOST-PHIVOLCS reminds the public that at Alert Level 2, sudden steam-driven or phreatic explosions, volcanic earthquakes, minor ashfall, and lethal accumulations or expulsions of volcanic gas can occur and threaten areas within and around TVI.

DOST-PHIVOLCS strongly recommends that entry must be strictly prohibited into Taal Volcano Island, Taal’s Permanent Danger Zone or PDZ, especially the vicinities of the Main Crater and the Daang Kastila fissure, and occupancy and boating on Taal Lake. Local government units are advised to continuously assess and strengthen the preparedness of previously evacuated barangays around Taal Lake in case of renewed unrest. Civil aviation authorities must advise pilots to avoid flying close to the volcano as airborne ash and ballistic fragments from sudden explosions and wind-remobilized ash may pose hazards to aircraft. DOST-PHIVOLCS is closely monitoring Taal Volcano’s activity and any new significant development will be immediately communicated to all stakeholders.

DETAILED GUIDELINES ON ECQ (ENHANCED COMMUNITY QUARANTINE) WHICH STARTED TODAY MARCH 29 AT 12:01 AM TO APRIL 4, 2021 CURFEW: 6:00 PM TO 5:00 AM

Guidelines Cover: *Implementation of temporary measures imposing stringent (strict) limitations on movement and transportation of people

* Strict regulation of operating industries

* Provision of food and essential services

*Heightened presence of uniformed personnel to enforce Community Quarantine Protocols

To address the rising cases of COVID-19, the following measures shall be in place
in areas under General Community Quarantine until 4 April 2021:
a.

The operations of driving schools, traditional cinemas and video- and
interactive- game arcades, libraries, archives, museums, and cultural
centers, limited social events at accredited establishments of the DOT, and
limited tourist attractions except open-air tourist attractions shall be
temporarily suspended;
b. Meetings, incentives, conferences, and exhibitions (MICE) events shall be
limited to essential business gatherings at thirty percent (30%) venue
capacity;
c. Religious gatherings shall observe a maximum of thirty percent (30%) of
the venue capacity provided that there is no objection from the local
government unit where the religious gathering may take place. Provided
further, that such LGUs have the discretion to allow higher venue capacity
not exceeding fifty percent (50%) based on conditions in their localities;
d. Venue capacity of dine-in restaurants, cafes, personal care services shall be
reduced to a maximum of fifty percent (50%) of capacity;
e. National government agencies are encouraged to defer the conduct of noncritical activities that would entail mass gatherings; and
f. Cockfighting and cockpit operations are suspended, including in areas
under Modified General Community Quarantine;


To implement the foregoing, all concerned government agencies are hereby
requested to issue the appropriate operational guidelines.

  1. Local government units shall retain the authority to impose a higher age limit for
    age-based restrictions for minors depending on the COVID-19 situation in their
    respective jurisdictions. The Metropolitan Manila Development Authority is
    directed to facilitate the establishment of reasonable and uniform exemptions with
    the local government units in the National Capital Region.

Philippine Red Cross Calls On Covid-19 Survivors To Donate Convalescent Plasma

Senator Richard Gordon, the chairperson and CEO of Philippine Red Cross is calling on covid-19 survivors to donate convalescent plasma that is very helpful in speeding up the recovery of covid patients in the hospital. Convalescent plasma is a blood plasma taken from people who have recovered from COVID-19. It contains antibodies that can recognize and neutralize SARS-CoV-2, the virus that causes COVID-19, as well as other components that may contribute to an immune response.

Preliminary observational studies conducted by the National Institutes of Health (NIH)  indicates that convalescent plasma may improve outcomes among severely ill and hospitalized patients with COVID-19. “The evidence on convalescent plasma as a treatment for severe cases of COVID-19 is promising but incomplete. We need to carry out rigorous randomized control clinical trials to determine how this therapy can improve outcomes,” said NIH Director Francis S. Collins, M.D., Ph.D. “While the world waits for an effective vaccine, it is vital that we simultaneously expand the options for available treatments for those currently suffering from the worst effects of this disease.”

The Spanish colonization of the Philippines was deeply embedded in the country's history. Until at present, Spanish words are still being used in the Philippines such as lamesa, kutsara, kutcharita, tinidor, tasa, kurtina, sapatos, lababo, kusina, tokador, and many others. A massive amount of historical establishments and houses are still being inhabited or used as tourist destinations to preserve the history of the Spanish colonization. Spanish speaking individuals who are living witnesses of the Spanish era are here to tell the story of how the Philippines was,  during the Spanish times.

Spanish was the official language of the Philippines from the beginning of Spanish rule in the late 16th century, through the Philippine–American War (1899-1902) and subsequent United States colonization and remained co-official after independence in 1946, along with English, until 1973. Its status was initially removed in 1973 by a constitutional change, but after a few months it was re-designated an official language again by a presidential decree. With the present Constitution, Spanish became designated as an auxiliary or "optional and voluntary language".
